Non-European Union

Guernsey is a well-established financial centre, in particular for investment funds, and is considered one of the leading jurisdictions for private equity, property and infrastructure funds. The Guernsey Financial Services Commission (GFSC) regulates the financial services industry. The expertise of the local service providers, the GFSC’s robust approach to regulation and the Island’s supportive fiscal environment each contribute to Guernsey’s strong position for continued growth in the funds sector.

Structures available in Guernsey include limited partnerships, companies and unit trusts. Fund structures established or incorporated in other jurisdictions may also be administered in Guernsey with the appropriate regulatory approvals, allowing clients to take advantage of Guernsey as a centre of excellence for Fund financial services. This regulatory flexibility offers promoters a variety of options when selecting Guernsey as an administration base for their funds without limiting jurisdictional preference.

European Union

Huge growth over the past few years has seen Malta become a fast-developing jurisdiction for investment funds and the country is now reporting more than 400 investment services licenses issued to date.  Malta’s Eurozone Membership signifies the country is well positioned when compared with other EU countries. With the introduction of passporting rights, investment funds and UCITS schemes can be registered in Malta and passported into other European Countries.

The Malta Financial Services Authority (MFSA) has a robust yet flexible approach to regulation. The MSFA have an open approach and encourage investment managers to discuss their proposed ventures, even at the gestation stage.

The popular structure in Malta for Collective Investment Schemes is the SICAV which benefits from a variable capital framework and the possibility of establishing sub funds within the structure. In addition, limited partnerships, investment companies, contractual funds and trusts are often used.

Typical routes of application include the Private Fund and Professional Investors Funds, of which the latter can be used for open or closed-ended funds.

United Kingdom

The UK and London in particular, is undoubtedly one of the world’s leading financial centres and with the UK continuing to be a leading jurisdiction for onshore collective investment funds, our Belfast and London offices are strategically situated to meet the needs of onshore investment managers and their structures.
